1.    Introduction

The Tyre Traders website (“the / this website) is an on-line information, communications and purchase / order service provided by Tyre Traders.  By using the website or ordering any of the Tyre Traders products offered hereon, or downloading any material from the website you consent to the Terms & Conditions set out hereunder as well as the Privacy Policy contained on this website.  The order and fitment of vehicle tyres offered on the website as part of the Tyre Traders services is subject to the Terms & Conditions set out hereunder. Failure and /or neglect and / or refusal to abide to the Terms & Conditions may result in Tyre Traders, in its sole and absolute discretion, refusing to accept any order or to provide any goods or services. It is therefore incumbent upon you to read the Terms & Conditions carefully before proceeding and to print a copy for future reference.
Tyre Traders reserve the right to change, add to, amend, delete or modify these Terms & Conditions at any time. Such changes, additions, amendments, deletions or modifications shall take legal effect when posted on this website and it is your responsibility to read these Terms & Conditions each time you use the website.

2.   Establishing the Contractual Relationship

2.1    You may order the goods and services listed on the website by completing the order and submitting your order on-line, or by downloading the order from, completing it and faxing it to us.  No telephonic orders will be accepted.

2.2    By submitting your order form, whether on-line or via fax and providing us with the information therein requested, you submit a legally binding and enforceable offer.

2.3    Tyre Traders will confirm your order via email, but such acknowledgment does not amount to an acceptance of such order on the part of Tyre Traders.

2.4    The contract between Tyre Traders and yourself will only take effect on payment by you to Tyre Traders and delivery of the goods and services by Tyre Traders to you.

2.5    By submitting your order you accept responsibility for the correctness of all information requested in the order from and submitted by you. You will be obliged to complete all relevant fields on and in the order from.

2.6    You also warrant and undertake to provide us with necessary and adequate information relating to the products and services ordered so that Tyre Traders are able to perform it’s obligations in terms of this contract. In the event that it is found on delivery or fitment that the products or goods ordered are incorrect or unsuitable due to incorrect information supplied by you, you will be liable for payment of a call out fee of R150.00 (one hundred and fifty rand) per kilometre.  This fee will be payable prior to delivery or fitment of the replacement products or goods.  Should you in such an event elect not to proceed with the order, Tyre Traders shall deduct the call out fee prior to making any refund to you.

2.7    In submitting your order you indemnify us from any and all liability as a result from inaccurate information supplied by you.

2.8    All tyre orders are subject to a minimum order value of 2 (two) tyres or R350.00 (three hundred and fifty rand). In the event of your order being less than the minimum order value, your order will be subject to a surcharge of R150.00 (one hundred and fifty rand) which will be added to the listed price / order value.

3.    Order, Payment, Delivery and Fitment

3.1    After Tyre Traders has confirmed your order as set out in 2.3 above, you will receive a further email confirming the availability of the goods and/or services ordered by you.

3.2    Tyre Traders accept payment on the website, by electronic fund transfer or at the time of fitting by Debit card or Credit card. All Tyre Traders mobile fitment units are equipped with a card machine.

3.3    Payment by you to Tyre Traders is to be effected prior to delivery or fitment, as the case may be.

3.4    All prices on the website are inclusive of Value Added Tax.

3.5    Tyre Traders accept American Express, Visa, MasterCard and Maestro cards. Tyre Traders do not accept Diners Club, cheques of any description, or any cash payment. For further details on the payment process, please refer to the Privacy Policy and Buy Tyres / The Payment Process.

3.6    Delivery of goods and/or service ordered by you will be effected within 72 (seventy two) hours of confirmation of your order set out in 2.3 above.

3.7    In areas where Tyre Traders have agents, the agent responsible for that area will carry out fitment. The applicable agent will contact you for the fitment appointment at your convenience.

3.8    The cost of the fitment in 3.6 is included in your purchase price.  

3.9    In areas where Tyre Traders do not have agents you will be responsible for fitment of any and all tyres ordered by you in terms of this contract.

3.10    The fitment in 3.6 includes balancing of all wheels so fitted, but does not include performing, or the cost of, wheel alignment.

3.11    In areas where no Tyre Traders agent is available, fitment will be your responsibility.

4.    Return and Warranty Policy in respect of Tyre Products

4.1    All tyre products supplied by Tyre Traders are subject to the warranties of the relevant tyre suppliers. All tyre products carry a 3 (three) year warranty against latent / apparent manufacturing deficiencies, and will be replaced on a concession basis dependent on the remaining tread depth of the tyre.

4.2    All claims under 4.1 are subject to the inspection and return policy of the   applicable tyre supplier.

4.3    Fitment of tyre products carried out by Tyre Traders agents carry a 30 (thirty) day warranty against faulty workmanship. All claims under this clause are to be submitted, in writing, to Tyre Traders.

4.4    All claims submitted in terms of 4.3 will be subject to a physical inspection by Tyre Traders and if necessary by an appointed representative of the relevant tyre supplier. In the event of a claim being accepted and acknowledged by Tyre Traders will be replaced within 48 (forty eight) hours.

4.5    Tyre Traders provides no further warranty in respect of tyre products other than the warranties set out in this clause 4,whether such warranty is implied, silent or tacit, and you in placing your order agree to the aforesaid.

5.    Content of the Website

5.1    Whilst Tyre Traders makes very effort to update the information provided on this website on a regular basis, Tyre Traders makes no representations or warranties, whether express, implied in law or residual, as to the accuracy, completeness and/or reliability of any information, data and/or content contained on the website) and shall not be bound in any manner by any information. The information made available on the website from time to time, should not at any time be construed as advice of whatever nature, including inter alia, investment advice.
5.2    Tyre Traders reserves the right at any time to change or discontinue without notice, any aspect or feature of this website. No information contained on the website shall be construed as advice and same are offered for information purposes only.

6.    Copyright & Intellectual Property Rights

6.1    The contents including but not limited to data, soundtracks, information, illustrations, logos, brands, etc. that appear or are available on this website are protected by South African and international copyright and other intellectual property rights and are the exclusive property of their respective publishers.

6.2    No part of the contents of this website in general, even if it belongs to a third party, may be copied, reproduced, represented, adapted, altered, modified or circulated fully or partially by any means whatever, with the exception of a single copy, stored on a single computer and reserved exclusively for the private use of the copier.

6.3    The trademarks, names, logos and service marks (collectively "trademarks") displayed on this website are registered and unregistered trademarks of Tyre Traders.

6.4    Nothing contained on this website should be construed as granting any license or right to use any trademarks without the prior written consent of Tyre Traders.

7.    General Provisions

7.1    These terms constitute the sole record of the agreement between you and Tyre Traders in relation to the subject matter hereof.
7.2    Neither you nor Tyre Traders shall be bound by any express, tacit nor implied representation, warranty, promise or the like not recorded herein.
7.3    No addition to, variation or cancellation of any provision of these terms shall be binding upon either you or Tyre Traders unless agreed to by Tyre Traders.
7.4    No indulgence or extension of time which either you or Tyre Traders may grant to the other will constitute a waiver of or, whether by estoppel or otherwise, limit any of the existing or future rights of the grantor in terms hereof, save in the event or to the extent that the grantor has signed a written document expressly waiving or limiting such rights.   
7.5    Tyre Traders shall be entitled to cede, assign and delegate all or any of its rights and obligations in terms of these terms of use to any third party.
7.6    Any provision of these terms which is or becomes unenforceable in any jurisdiction, whether due to voidness, invalidity, illegality, unlawfulness or for any reason whatever, shall, in such jurisdiction only and only to the extent that it is so unenforceable, be treated as pro non scripto and the remaining provisions of these terms shall remain in full force and effect.   
7.7    Should Tyre Traders be prevented from fulfilling any of its obligations to you as a result of any event of force majeure, then those obligations shall be deemed to have been suspended to the extent that and for as long as Tyre Traders is so prevented from fulfilling them and your corresponding obligations shall be suspended to the corresponding extent. In the event that force majeure continues for more than thirty days after it has first occurred then Tyre Traders shall be entitled (but not obliged) to terminate all of its rights and obligations in terms of or arising out of these terms by giving notice to you. An "event of force majeure" shall mean any event or circumstance whatsoever which is not within the reasonable control of the affected party including, without limitation, vis major, casus fortuitus, any act of God, strike, theft, riots, explosion, insurrection or other similar disorder, war (whether declared or not) or military operations, the downtime of any telecommunications line and/or unavailability of any telecommunications facilities, power failure, international restrictions, any requirement of any international authority, any requirement of any government or other competent local authority, any court order, export control or shortage of transport facilities.
7.8    These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa without giving effect to any principles of conflict of law. You hereby consent to exclusive jurisdiction of the High Court of South Africa in respect of any disputes arising in connection with these terms or any matter related to or in connection therewith.
